1. Acceptance of Terms

By accessing or using the LeadsCaller platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Service. These terms apply to all users, including individuals and organizations that create accounts.

2. Description of Service

LeadsCaller provides an AI-powered outbound calling platform that enables users to automate sales and outreach calls using artificial intelligence agents. The Service includes AI voice agents, campaign management, lead management, call analytics, and human handoff functionality.

3. User Responsibilities for Lead Data

You are solely responsible for all lead data and contact information you upload, import, or otherwise provide to the Service. By uploading leads, you represent and warrant that:

  • You have obtained all necessary consents and permissions to contact each individual or entity on your lead lists.
  • Your lead data was collected lawfully and in compliance with all applicable data protection regulations, including but not limited to GDPR, CCPA, TCPA, and any local telemarketing laws.
  • You have honored and will continue to honor all opt-out and do-not-call requests.
  • You will not upload leads that are on any national or regional do-not-call registry unless you have a valid exemption.
  • You have the legal right to initiate automated and AI-assisted calls to all contacts in your lead lists.

LeadsCaller does not verify the legality or consent status of the leads you upload. You bear full legal and financial responsibility for any claims, fines, or damages arising from unauthorized or unlawful contact with your leads.

4. AI-Generated Content Disclaimer

The AI agents deployed through the Service generate spoken responses in real time based on the scripts and instructions you configure. You acknowledge and agree that:

  • AI-generated speech may contain inaccurate, incomplete, or unintended statements. LeadsCaller does not guarantee the accuracy, appropriateness, or correctness of anything the AI says during calls.
  • You are responsible for reviewing, configuring, and testing your AI agent scripts before launching campaigns.
  • You are solely liable for any claims, damages, or consequences arising from statements made by AI agents acting on your behalf, including any misrepresentations, false promises, or misleading information communicated during calls.
  • AI agents operate as your automated representatives. Any commitments, offers, or statements made by your AI agents during calls may be legally attributed to you or your organization.
  • LeadsCaller is not responsible for any business outcomes, lost deals, reputational harm, or regulatory penalties resulting from AI-generated call content.

5. Compliance with Telemarketing Laws

You are solely responsible for ensuring that your use of the Service complies with all applicable federal, state, and international telemarketing regulations, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), GDPR, and any other relevant laws. This includes complying with calling hour restrictions, caller ID requirements, disclosure obligations, and consent requirements. LeadsCaller provides tools to help with compliance (such as do-not-call list management) but does not provide legal advice and makes no guarantees of regulatory compliance.

6. Acceptable Use

You agree not to use the Service to:

  • Make calls that are harassing, threatening, abusive, or fraudulent.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Engage in any activity that violates applicable laws or regulations.
  • Transmit malware, viruses, or harmful data through the platform.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Use the Service for robocalling or any purpose prohibited by applicable telecommunications regulations.

7. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify LeadsCaller immediately of any unauthorized access or use of your account.

8. Intellectual Property

The Service, including its software, design, logos, and documentation, is the property of LeadsCaller and is protected by intellectual property laws. You retain ownership of the content and data you upload. By uploading content, you grant LeadsCaller a limited license to process that content solely for the purpose of providing the Service.

9. Limitation of Liability

To the maximum extent permitted by law, LeadsCaller and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising out of or related to your use of the Service. LeadsCaller's total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim. This limitation applies regardless of the theory of liability, including breach of contract, tort, or strict liability.

10. Indemnification

You agree to indemnify, defend, and hold harmless LeadsCaller and its affiliates from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) the lead data you upload or the calls made using your account; or (d) any statements made by AI agents configured by you.

11. Termination

LeadsCaller may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, third parties, or the business interests of LeadsCaller. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

LeadsCaller reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the platform. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
